Clinician Terms
Last updated October 19, 2026
Independent clinicians
These terms are between you and DOC MD, Inc., a Delaware corporation incorporated on October 15, 2026, 7405 Charmant Dr Unit 2001, San Diego, CA 92122. They apply when you create a clinician account on the DOC MD website or apps.
You are an independent clinician. Creating an account does not make you an employee, partner, or agent of DOC MD, and it does not make DOC MD your employer. You keep your own clinical judgment. DOC MD does not control your diagnosis, treatment, referrals, prescribing, or other clinical decisions. DOC MD provides scheduling, video, storage, and related software. The patient-facing description of that split is in the Patient Terms.
Licensure and the standard of care
You may provide a visit only when you are licensed, in good standing, in the patient’s state for the service you provide. You are responsible for confirming that license before the visit. The platform does not yet verify state licenses in software.
You are responsible for the standard of care, for identifying yourself to the patient, and for any consent the law requires from you in addition to the telehealth consent the platform stores. You are responsible for the records you write, for how long those records must be kept under the law that applies to you, and for your own professional liability insurance.
Prescribing
If you prescribe, you do so in your own name and under your own authority. If you prescribe a controlled substance, you must follow the federal and state rules in effect at the time of prescribing, including the Ryan Haight Act and current DEA requirements. Temporary federal telemedicine flexibilities are not a permanent term of this agreement and are not a feature the software turns on or off.
Privacy
You may enter health information for a patient only when that patient has consented to collection and to sharing, and you may join a video visit only when that patient has also given telehealth consent. The service blocks those actions otherwise. You will not use patient information for advertising or for any purpose outside the visit and the chart. The AWS Business Associate Addendum is in place, effective October 17, 2026, for AWS End User Messaging SMS and Amazon Chime SDK Meetings. Business associate agreements with Vercel and MongoDB are not in place. Do not use the service for a real patient’s information until DOC MD confirms the HIPAA role and any required agreements. The Privacy Policy describes what the software actually stores and deletes.
Not for emergencies
DOC MD is not an emergency service and is not monitored for emergency response. You will not tell a patient to use the app, the AI tools, or a message thread for an emergency. If a patient may be in an emergency, direct them to call 911.
Accounts
You must be 18 or older. Clinician accounts stay closed until an administrator approves them. DOC MD may refuse or close an account that breaks these terms or that it cannot verify. Closing your account does not erase notes or prescriptions already stored on a patient’s chart. Those remain so the patient can still see them.
AI
AI output on the platform supports your review. It is not emergency triage, not a diagnosis, and not an independent treatment decision. You will not treat it as one.
Disputes and governing law
These terms are governed by the laws of the State of California. Disputes that are not subject to a non-waivable law will be resolved under the dispute section of the Patient Terms, including individual arbitration, the class waiver, the small-claims carveout, and venue in San Diego County, California. You may opt out of arbitration within 30 days after you create the account by emailing care@docmdapp.com with the subject “Arbitration opt-out.” Statutory remedies that cannot be waived are not waived.
