Patient Terms
Last updated October 19, 2026
The platform
These terms are between you and DOC MD, Inc., a Delaware corporation incorporated on October 15, 2026, 7405 Charmant Dr Unit 2001, San Diego, CA 92122. They cover patient use of the DOC MD website and the iOS and Android apps. Clinicians are covered by the Clinician Terms.
DOC MD, Inc. is a technology platform. It does not practice medicine and it does not control diagnosis, treatment, referrals, or other clinical decisions. Care is provided by the independent treating clinician named when you book the visit. The booking screen shows that clinician’s name. No clinician-patient relationship is formed with DOC MD, Inc.
Not for emergencies
DOC MD is not an emergency service. It is not monitored for emergency response. Do not use the service, the AI tools, messages, or a delayed reply for an emergency. If you need emergency help, call 911 or your local emergency number.
Who can use a patient account
You must be 18 or older to hold an account. Registration asks you to attest that you are 18 or older, and that attestation is stored with the time and your account id. DOC MD will offer all specialties, including pediatrics, as our network grows. You agree to give a real name and an email address you can open, and to keep your password to yourself. You are responsible for activity on your account.
Visits and AI
Video visits use Amazon Chime. You need a camera and microphone, and you can turn either one off during the call. DOC MD does not save a recording of the visit. Do not record the other person unless they agree and the law allows it.
Before the first video visit, you must accept the Telehealth Informed Consent. Acceptance of these terms is not a substitute. The consent is stored with its version and the time. You can withdraw it in Settings. A video visit cannot start until that consent, and the separate consumer-health consents, are on the account.
AI output supports the treating clinician’s review. It is not emergency triage, it is not a diagnosis, and it is not an independent treatment decision. Do not rely on it for an emergency.
Your information
The Privacy Policy and the Consumer Health Data Privacy Policy describe what is collected, who receives it, how long it is kept, and how to ask for access or deletion. Collection of consumer health data and sharing of that data with the treating clinician and the service providers needed to run the visit are separate checkboxes. Both start unchecked. Health information cannot be entered until both are given. You can withdraw either one in Settings.
The AWS Business Associate Addendum is in place, effective October 17, 2026, for AWS End User Messaging SMS and Amazon Chime SDK Meetings. Business associate agreements with Vercel and MongoDB are not in place, and DOC MD has not decided whether it is a HIPAA covered entity or a business associate. Do not send a real patient’s information until that is resolved. These terms are not a statement that a HIPAA program is complete.
SMS and mobile messaging
The program name is DOC MD. Creating an account means DOC MD may email the address on the account about the service. Text messages are separate. DOC MD texts the phone number you provide only if you check the text-message box. That box starts unchecked and is not required to use the service. A phone number is optional.
Text messages are appointment reminders, visit notifications, and account security codes. They do not include symptoms, notes, medications, or a diagnosis. Message frequency varies. Msg & data rates may apply.
Reply STOP to opt out, or HELP for help. You can also email care@docmdapp.com. Wireless carriers are not liable for delayed or undelivered messages.
How phone numbers and text-message consent are handled is described in the Privacy Policy.
Fees
The service does not charge a patient fee in the product today. If a fee is added, the amount and any cancellation or refund rule will be shown before you pay, and these terms will be updated.
Deleting your account
You can delete a patient account in the iOS or Android app. Open Settings, choose Delete account, and confirm. You can also email care@docmdapp.com. Deletion removes the account and the visits, notes, prescriptions, and reminders stored for it from the active database. A short deletion record keeps the account id and the time. It does not keep the clinical contents. The Privacy Policy describes what remains.
Acceptable use
You agree not to:
- Use the service for an emergency
- Break the law, or misuse someone else’s account or visit
- Upload malware, probe the service, or try to bypass access controls
- Scrape, resell, or misrepresent the service
- Harass another person, or share their health information without a right to do so
Changes
DOC MD may add, change, or remove features, and may suspend the service for maintenance or security. Updated terms will be posted on this page with a new date. For a material change, DOC MD will email the address on the account before the change applies. Where a law requires a new consent, the service will ask for that consent again.
Disputes and governing law
These terms are governed by the laws of the State of California, except that a non-waivable consumer protection, medical privacy, or consumer health data law of your state still applies. Except for the claims listed below, you and DOC MD agree to binding individual arbitration of disputes arising out of these terms or the service. The arbitration will be administered by JAMS under its consumer rules, or by the American Arbitration Association under its consumer rules if JAMS is unavailable. It will be held in San Diego County, California, or by video if you prefer. The arbitrator may award any individual relief a court could award. You and DOC MD waive any right to a class, collective, or representative action.
You may opt out of arbitration within 30 days after you create the account by emailing care@docmdapp.com with the subject “Arbitration opt-out” from the address on the account. Either party may bring an individual claim in small claims court in San Diego County. Claims for public injunctive relief, and rights that a statute says cannot be arbitrated or waived, including rights under the Confidentiality of Medical Information Act and the consumer health data laws named in the Consumer Health Data Privacy Policy, are not waived by this section. If a court finds the class waiver unenforceable as to a claim, that claim proceeds in court and the rest stays in arbitration.
To the extent the law allows, DOC MD, Inc. is not liable for indirect, incidental, or consequential damages, or for lost profits, arising from use of the software. Direct damages for claims that can be limited are capped at the fees you paid DOC MD for the service in the 12 months before the claim, or $100 if you paid no fee. This cap does not apply to statutory damages or other remedies that a law says cannot be limited, including remedies under the Confidentiality of Medical Information Act. Nothing in these terms takes away a non-waivable consumer protection right.
If a dispute is not arbitrated, the state and federal courts located in San Diego County, California, are the exclusive venue, and you consent to personal jurisdiction there.
